The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of . Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

1. PAYMENT AND FEES

Customer agrees to pay all fees associated with OffshoreVPS.io services, including those for the initial term, renewal term, and any supplemental services requested on an emergency or "one-off" basis.

1.2 Supplemental Services:

Customer authorizes OffshoreVPS.io to charge fees for supplemental services and acknowledges that these services may be performed without prior notice.

Delivery of Services and Terms

OffshoreVPS.IO agrees to provide services to the Customer, subject to the following Terms of Service (ToS). The use of OffshoreVPS.IO's services constitutes acceptance of these ToS. OffshoreVPS.IO reserves the right to modify these ToS without notice.

Usage of OffshoreVPS.IO Services

2. To ensure the efficiency and integrity of OffshoreVPS.IO's services, customers must adhere to the following terms:

   2.1 Server Storage & Bandwidth

   Customers may utilize only the allocated bandwidth, disk space, and Mbps speed specified in the Order Form. Additional charges will apply for exceeding these resources. If excessive resource usage interferes with other account holders on the same server, OffshoreVPS.IO reserves the right to deactivate the service until a resolution is reached.

2.2 Sharing Account Resources

2. Customers may share their account resources with other account-less users but are strictly prohibited from distributing or selling them for free within or on top of an existing account. Violation may result in permanent suspension of service.

2.3 Unnecessary Usage of Resources and/or Abuse

2. Accounts causing disruption to the operation of other services may be temporarily suspended until a resolution is achieved.

2.4 Server Vulnerabilities & Updates

2. Customers grant OffshoreVPS.IO permission to address vulnerabilities and enforce updates to ensure the security of servers and clients. The company reserves the right to take necessary actions to prevent vulnerabilities in older software versions.

2.5 Delivery Policy

2. All store services have instant activation. Details will be emailed to the provided mailbox shortly after payment. Dedicated servers may experience delays up to 24 hours due to form errors.

3. Fees & Payment Terms

Customers are responsible for paying all fees according to the terms and prices outlined in the Order Form(s) and any additional fees associated with Professional Services, Supplemental Services, service reinstatement, or changes/upgrades. Payment must comply with current OffshoreVPS.IO policies.

3.1 Invoice Notifications

2. Invoices will be sent to the primary email address. OffshoreVPS.IO offers a Billing Control Panel (Client Portal) for reviewing and paying invoices.

3.2 Suspensions and Termination

2. Failure to make payments within 3 days of the due date may result in service suspension. If payment confirmation is not received within 14 days, OffshoreVPS.IO reserves the right to terminate the service without further notice.

3.3 Account Cancellations

2. Customers not under agreement can cancel their account at any billing cycle. Cancellations must be made at least 4 days in advance through the Client Portal/Billing Control Panel. OffshoreVPS.IO is not responsible for charges incurred after cancellation.

4. Intellectual Property Ownership

This agreement does not transfer any OffshoreVPS.IO intellectual property to the customer. All rights remain with OffshoreVPS.IO. Customers agree not to disassemble, reverse engineer, or attempt to obtain source code or trade secrets.

5. Limited Warranties

Warranties specified in the Order Form(s) are void if customers do not comply with OffshoreVPS.IO's ToS or violate the agreement.

5.1 No Other Warranty

2. OffshoreVPS.IO does not control the content transmitted through its infrastructure. Services are provided on an 'as is' basis, and the customer uses them at their own risk.

5.2 Disclaimer of Actions Caused By and/or Under the Control of 3rd Parties

2. OffshoreVPS.IO cannot control the flow of information on the Internet. Events caused by or related to the actions of third parties are not guaranteed, and OffshoreVPS.IO disclaims liability for such events.

6. Limitations of Liability

OffshoreVPS.IO is not liable for damages, including loss of profits or data, related to the use of its website or services. Cumulative liability does not exceed the client's hosting costs. Customers agree to defend and indemnify OffshoreVPS.IO against penalties, liabilities, costs, damages, attorney fees, and claims arising from their use of services.

7. Payments, Cancellations, & Refunds

7.1 Payments

2. Invoices must be paid within three days to avoid service suspension. Suspension occurs on the third day, and termination occurs on the 15th day after the invoice.

7.2 Cancellations

2. To terminate service, customers must cancel through the Client Portal/Billing Panel. Cancellation eliminates site files from OffshoreVPS.IO's services. Refunds are not provided for accidental payments after cancellation.

7.3 Refunds

2. OffshoreVPS.IO offers a 30-day money-back guarantee for shared hosting plans. No refunds are given for Bitcoin or altcoin payments, control panel licenses, or domains. After 30 days, no refunds are available.
